Terms and Conditions for the Fishy Live Platform and Marketplace

1. Parties and scope

These Platform and Marketplace Terms and Conditions (”Terms”) apply to all users of the Fishy Live Platform, including visitors, contestants and organizers (collectively, ”Users”).

The platform is provided by Fishy Tech Sweden AB, corporate registration number 559206-1641, Ginstvägen 3, 197 34 Bro, Sweden (”Fishy Tech”, ”we”, ”us”).

These Terms govern access to and use of Fishy Live, including websites, mobile applications, reporting tools, online stores, administrative dashboards and related digital services (collectively, the "Platform").

2. Fishy Tech's role (marketplace information)

Fishy Tech operates the platform primarily as a technology provider and marketplace operator.

Unless otherwise expressly stated for a specific event or product, Fishy Tech:

Does not organize fishing competitions;

Does not act as a legal seller of event registration fees or event-related products;

Does not define competition rules, scoring, rankings, or prize payouts;

Does not act as a payment processor or financial institution;

Does not accept customer funds for own account.

Each fishing competition or fishing event is typically created, owned and operated by an independent competition organizer (the ”Organizer”), who acts as the legal seller and is responsible for the event and its implementation.

Payments may be processed by a local partner or payment processor, who may appear as the merchant in the payment interfaces. Fishy Tech is not responsible for payment execution, settlement, or refunds.

Fishy Tech is not responsible for VAT or other indirect taxes attributable to sales via the Platform. Such treatment is specifically regulated in Section B (VAT).

Important market-specific note

In certain markets, Fishy Tech Sweden AB may also act as a local country operator and/or as a tournament organizer for specific events.
Where Fishy Tech acts in such a role, this will be clearly and explicitly stated on the relevant product page, at checkout and in the applicable terms and conditions. In such cases, Fishy Tech's role and responsibilities will be defined by the specific terms and conditions presented for that event or product.

3. The relationship between users and organizers

When you purchase an entry fee (for example, a registration fee) or participate in an event:

The User enters into a direct legally binding agreement with the Organizer;

The organizer's terms of sale and event rules apply;

The organizer is responsible for VAT, taxes, consumer rights, event implementation, changes, cancellations, results and prizes.

Fishy Tech is not a party to the sales agreement between the User and the Organizer unless otherwise expressly stated.

The Organizer is responsible for applicable VAT, taxes and fees in connection with the sale of entry fees and products, in accordance with Section B.

4. Access to the platform and accounts

Some features on the platform require the creation of an account.

Users are responsible for:

Provide accurate and complete information;

Keep login details confidential;

All activity performed through their account.

Fishy Tech may restrict, suspend or terminate access where necessary for security, compliance with laws, abuse or violation of these Terms.

5. Availability and service as is

The Platform is provided on a best-effort basis, "as is" and "as available".

Fishy Tech does not warrant that the Platform will be uninterrupted, error-free or continuously available. Temporary interruptions may occur due to maintenance, updates, third-party dependencies or circumstances beyond Fishy Tech's reasonable control.

6. Acceptable Use

Users may not:

use the Platform in violation of applicable law or event rules;

attempt to circumvent security or technical protection measures;

upload illegal, misleading, offensive or infringing content;

disrupt the operation of the Platform or that of other users;

Misuse reporting, assessment or administrative tools.

Fishy Tech may remove content or restrict access where necessary to protect the Platform, other users, or to comply with legal requirements.

7. Intellectual property rights

All intellectual property rights to the Platform, including software, design, trademarks and documentation, belong to Fishy Tech or its licensors.

Users are granted a limited, non-exclusive right to use the Platform for its intended purposes. No ownership rights are transferred.

8. Personal data and privacy (GDPR)

Fishy Tech processes personal data in accordance with applicable data protection law, including the EU General Data Protection Regulation (GDPR).

For platform operation, Fishy Tech typically acts as a data processor on behalf of the organizers. For its own administrative purposes, Fishy Tech acts as the data controller.

Further information about data processing, rights and safeguards is described in Fishy Tech's privacy policy, which is available on the platform. Organizers enter into a separate data processing agreement (DPA) with Fishy Tech where required.

9. Cookies and tracking

The platform uses cookies and similar technologies for functionality, security, analytics and user experience. Details about the use of cookies and choices are described in Fishy Tech's cookie policy, which is available on the platform.

10. Third-party services

The platform relies on third-party services such as web hosting providers, payment gateways, mapping services, email/SMS providers, and analytics tools. Fishy Tech is not responsible for any interruptions, errors or failures caused by third-party services beyond its reasonable control.

11. Changes to the terms and conditions

Fishy Tech may update these terms and conditions from time to time.
Material changes will be communicated via the Platform or other reasonable means. Continued use of the Platform after updated Terms become effective constitutes acceptance.

12. Limitation of liability

To the extent permitted by applicable law:

Fishy Tech is not responsible for the event's implementation, competition results, prize decisions, or the organizer's behavior.

Fishy Tech is not responsible for payment processing, settlement or refunds handled by Organizers or payment processors;

Fishy Tech is not liable for indirect or consequential damages, including loss of income, data, or business opportunities.

Nothing in these terms and conditions limits any liability that cannot be excluded by mandatory law.

This includes, without limitation, liability for value added tax and other taxes regulated in Section B.

13. Suspension and termination

Fishy Tech may temporarily suspend or permanently terminate access to the Platform in cases of abuse, legal requirements, security risks, or material violations of these Terms.

14. Mandatory consumer rights

Nothing in these terms and conditions affects any rights that cannot be waived under applicable consumer protection laws. Mandatory consumer rights always apply where relevant.

15. Applicable law and disputes

These terms and conditions are governed by Swedish law. Disputes shall be decided by Swedish general courts, with Stockholm District Court as the first instance, unless mandatory law provides otherwise.

Section B — Terms of Participation and Reporting in the App

16. Participation and reporting tools

The reporting app and participation tools are provided as technical aids for submitting competition data such as catch reports, photos, measurements, timestamps, and location data.

Fishy Tech does not verify the actual accuracy of submitted information.

17. Data Submission and Accuracy

Contestants are solely responsible for ensuring that submitted information is accurate, truthful and in accordance with the event rules and the organizer's instructions.

Offline submissions depend on device functionality and user behavior and can be uploaded later when connectivity is restored.

18. Fair Play and Disqualification

The organizers have full authority to review entries, approve or reject reports, interpret rules, disqualify participants, and determine rankings and results.

Fishy Tech does not intervene in assessments.

19. Non-responsibility for results and prizes

Fishy Tech does not select winners, award prizes, or resolve contest disputes. All contest-related decisions rest entirely with the organizer.

20. Content rights

By uploading content, contestants grant Fishy Tech and the organizer a non-exclusive, worldwide right to display such content on the Platform and related event pages for competition and results purposes. Ownership remains with the uploader.

21. Suspension of participation

Fishy Tech may restrict access to reporting tools in the event of abuse, suspected cheating, security issues, or violations of these terms and conditions or the organizer's rules.

Section B – Value Added Tax (VAT) and Indirect Taxes

B1. Sales role

The Organizer (”Client”) is always the legal seller to the end customer for all sales via the Platform. Fishy Tech and any local partners act only as technical intermediaries and are not sellers, taxpayers or payees on their own behalf, unless otherwise expressly stated.

All local sales activities are conducted by local organizers, if necessary in collaboration with local partners.

B2. VAT and tax information

The client is responsible for providing correct VAT status, valid VAT/GST number and applicable VAT and tax rates according to local law in the relevant jurisdiction.

C3. Prices and payout

Prices on the Platform are displayed based on the Client's details. Fishy Tech or local partner can technically collect and disburse funds, but is not responsible for the accuracy of VAT or tax details and is not a taxable party.

C4. Client's responsibilities

The client is fully responsible for the declaration, accounting and payment of VAT and other indirect taxes, as well as for compliance with applicable accounting and reporting requirements.

C5. Limitation of liability

Fishy Tech and its partners are not responsible for tax errors resulting from the Client's information or omissions. The Client shall indemnify Fishy Tech and its partners from tax claims or penalties arising in connection with the sale.

GDPR Data Retention and Handling – Public Supplement

Fishy Tech Sweden AB

Fishy Tech Sweden AB takes the protection of personal data seriously and is committed to processing personal data in a transparent, secure and lawful manner in accordance with the EU General Data Protection Regulation (GDPR) and applicable national legislation. This document describes how we view GDPR responsibilities within the Fishy Live ecosystem and how we handle data retention, anonymization and data subject rights. This addendum complements our Privacy Policy and other legal documents available on this website.

Our role and the Fishy ecosystem

Fishy Tech Sweden AB provides the Fishy Live platform, including the Admin Panel, mobile applications, referee tools and technical integrations. In most cases, Fishy Tech acts as personal data processor, while competition organizers act as data controllers for participant data and competition-related data. Payment partners ("Country Operators") act as independent or joint data controllers for payment processing. Each party is responsible for compliance with the GDPR within their respective role, and responsibilities are clearly separated to ensure lawful processing.

Principles we follow

We process personal data only for clearly defined purposes, based on valid legal grounds, and only for as long as necessary. We apply the GDPR principles of lawfulness, fairness, transparency, data minimization, accuracy, storage minimization, and integrity and confidentiality. Personal data is protected by technical and organizational security measures, and access is limited to authorized personnel.

Storage times

Personal data is stored for defined periods depending on the purpose and legal basis:

Participant registrations and competition bookings stored in 3 years after a competition has ended. After this period, the data will be subject to automatic anonymization.
Legal basis: Contract (Art. 6(1)(b))

Catch reports and related competition data (including comments and photos) are stored in 3 years after the end of the competition. After this period, reports are anonymized by purging personal comments and removing photos where applicable.
Legal basis: Contract + Legitimate interest

Orders, payments and financial documents stored in 7 years, in accordance with accounting and tax legislation. This data is limited to compliance purposes during the retention period and anonymized where legally permitted when the obligation ends.
Legal basis: Legal obligation (Art. 6(1)(c))

Communication logs (such as support messages and system communications) are stored in 1 year and is subsequently deleted or anonymized.
Legal basis: Legitimate interest

Non-personal statistical and analytical data may be stored indefinitely when it is fully anonymized.

Anonymization and security

When personal data reaches the end of its retention period, it is anonymized using irreversible methods. This includes replacing names with Anonymous User, text field with Anonymous, and email addresses with anonymized values with the domain redacted.local.
Due to the public exposure of our e-commerce environment, personal data stored in the online store is anonymized on a more frequent automated schedule when legal and operational requirements are met. Anonymization is irreversible and logged for compliance and audit purposes.

Data subject rights

Individuals whose data is processed within the Fishy Live ecosystem have the right to request access, rectification, restriction, data portability and erasure of their personal data, in accordance with the GDPR. We will respond to GDPR requests without undue delay and no later than 30 days from receipt. In complex cases, this period may be extended in accordance with the provisions of the GDPR. Requests exceeding 30 days are treated as critical and escalated internally.

Legal restrictions and exceptions

In certain situations, such as in the event of disputes, fraud investigations or legal obligations, personal data may need to be stored for longer than the standard retention period. Such extensions are documented, limited in scope and regularly reviewed. When the legal basis for extended storage no longer exists, anonymization is carried out in accordance with applicable policy.

Transparency and scrutiny

All GDPR-related actions, including export, rectification, anonymization, and deletion, are logged and auditable. This data retention policy is reviewed regularly to ensure continued compliance with the GDPR, changing legal requirements, and data protection best practices.
